Fondazione Modena Arti Visive with registered office in Modena, Via Emilia centro no. 238 (the “Foundation”), in the capacity of personal data controller pursuant to Legislative decree no. 196/2003 and subsequent amendments – Code on Personal Data Protection (the 'Code') – and Regulation EU 679/2016, applicable as of 25 May 2018 – General Data Protection Regulation (the 'GDPR') (the Code and GDPR are referred to jointly as the 'Applicable Regulations') recognizes the importance of protecting personal data and therefore considers the provision of this protection one of its goals.

Before providing any personal data, the Foundation invites you to carefully read this privacy policy which contains important information on the protection of personal data and the security measures adopted to guarantee confidentiality in full observance of the Applicable Regulations (the 'Privacy Policy').

Furthermore, this Privacy Policy is understood to apply solely and exclusively to the website 'Website'), and not to other websites that may be consulted via external links; this information is provided to those who may interact with the Website pursuant to art. 13 of the Applicable Regulations; it complies with Recommendation no. 2/2001 relating to the minimum requirements for the collection of online data in the European Union, adopted on 17 May 2001 by the Article 29 Data Protection Working Party.

The Foundation informs you that your personal data will be processed following principles of lawfulness, fairness, transparency, purpose and storage limitation, data minimization, accuracy, integrity and confidentiality.Therefore, your personal data will be processed in accordance with the legislative measures in the Applicable Regulations and the confidentiality obligations provided for therein.

1. Data controller.

In light of the Applicable Regulations, the Foundation is the Website’s data controller.


2. Personal data that will be processed.

“Personal Data” means any information relating to an identified or identifiable natural person, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, mental, economic, cultural or social identity of that natural person.

The Website collects the following Personal Data:

a. Browsing data.

The Website’s IT systems collect some Personal Data whose transmission is implicit in the use of Internet communication protocols.It is information that is not collected in order to be associated with you, but which by its very nature could enable you to be identified if processed and associated with data held by third parties.This data includes the IP addresses or domain names of the devices used to connect to the Website, URI (Uniform Resource Identifier) addresses of the requested resources, request time, method used to submit the request to the server, size of the file obtained in response, numeric code indicating the response status from the server (successful, error, etc.)and other parameters relating to your operating system and IT environment.

These data are used in order to obtain anonymous statistical information on the use of the Website and to check that it works correctly; because of the systems architecture used, to enable the correct provision of the various functions that you request; for security reasons and to determine liability in the event of hypothetical IT crimes against the Website or third parties. They are cancelled after 7 days.

b. Data provided voluntarily.

The Website gives the possibility of voluntarily providing Personal Data such as your name and email address in order to contact the Foundation using the “Contact us” forms.

The Foundation will process these data in observance of the Applicable Regulations, in the assumption that they refer to you or to third parties who expressly authorized you to give them to us based on appropriate legal grounds which legitimize the processing of the data in question.In these cases, you become the independent data controller, thereby assuming all legal obligations and responsibilities.To this effect, you fully indemnify us against any complaint, claim, request for damages resulting from the processing, etc. that the Foundation may receive from third parties whose Personal Data have been processed through your use of the Website contravening the Applicable Regulations.

c. Cookies and similar technologies.

The Foundation uses cookies to collect Personal Data.


3. Data processing methods.

The personal data are processed by automated tools; the Foundation adopts all suitable security measures in order to prevent data loss, illicit use and unauthorized access to the data.


4. Transfer.

The Foundation guarantees that the processing of your Personal Data by electronic means and on paper takes place in observance of the Applicable Regulations.Any transfer will be based either on an adequacy decision or on the Standard Model Clauses approved by the European Commission.


5. Data retention.

The Foundation will retain your Personal Data for the time strictly necessary to provide the requested service.

In any case, the Foundation will retain your Personal Data for the period permitted by Italian law for the protection of its interests (Art. 2947 of the Italian Civil Code).


6. Your rights.

Within the limits of the Applicable Regulations, at any moment you have the right to request the Foundation for access to your Personal Data, to rectify or cancel them or oppose or restrict their processing and to obtain the data relating to you in a common, structured format that allows for its automated reading.

Pursuant to the Applicable Regulations, in any case you have the right to complain to the competent control authority (i.e. the “Personal Data Protection Authority”) should you deem the processing of your personal data to be contrary to the regulations in force.


7. Amendments.

This Privacy Policy has been in force since 25 May 2018.

The Foundation may amend or simply update its contents, in part or in full, also because of variations in the Applicable Regulations.

The Foundation will inform you of these variations as soon as they are introduced and they will become binding as soon as they are published on the Website.

Therefore, the Foundation invites you to regularly visit this section in order to view the most recent and updated version of the Privacy Policy so that you are always up-to-date as to what data are collected and their use by the Foundation.
